D.I.D. RACING CHAINS PRODUCT LINE IN VIVID RACING

The products of D.I.D. Racing Chains included in Vivid Racing are: motorcycle chains, super non-O-ring chains, chain tools, hand tools, and many more.

D.I.D Professional O-Ring Chains are warranted only against manufacturer’s defects in material and workmanship for 6 months from the original purchase date or 10,000 miles, whichever occurs first. The warranty begins on the date shown on the sales invoice or receipt.

D.I.D Professional X-Ring Chains are warranted only against manufacturer’s defects in material and workmanship for 1 year or 20,000 miles, whichever occurs first. The warranty begins on the date shown on the sales invoice or receipt.

D.I.D Standard and Professional Non-O-Ring Chains are warranted only against manufacturer’s defects in material and workmanship for 30 days from the original purchase date shown on the sales invoice or receipt. No mileage warranty applies.

All D.I.D Exclusive Racing Chains are manufactured to the highest possible quality standards under the racing condition. The ER series Non-O-Ring and X-Ring® Chains are designed to provide “cutting edge” performance for 21st Century competition on the most demanding tracks worldwide. Each ER Chain model is designed for a balanced weight vs. strength relationship considering specific horsepower, torque and weight criteria. As with many racing components, all ER Chain models are warranted ONLY against manufacturer’s defects in material and workmanship for 30 days from the purchase date shown on the sales invoice or receipt. No mileage warranty applies.

There is no warranty of any kind whatsoever, whether implied or otherwise, for any D.I.D chain used in racing competition or in a competitive event. No warranty of any kind shall apply for D.I.D chains used on motorcycles that have been modified.

D.I.D chains are not warranted against normal wear, incorrect installation, incorrect alignment, poor maintenance, misapplication (see motorcycle owner’s manual for manufacturer’s original equipment specification) or damage due to any alteration of a motorcycle.

All warranty claims must be made to the original dealer where the chain was purchased, and purchaser must return the D.I.D chain and proof of purchase to the original dealer in order for the warranty to apply. The dealer will file claims with the authorized D.I.D distributor from whom the chain was purchased.

D.I.D AND ITS SUBSIDIARY AND AFFILIATED ENTITIES’ (“D.I.D”) SOLE LIABILITY

SHALL BE FOR MANUFACTURING DEFECTS IN MATERIAL AND WORKMANSHIP IN THE CHAIN. D.I.D’S SOLE OBLIGATION UNDER THE EXPRESS WARRANTIES MADE HEREIN SHALL BE TO REPLACE THE DEFECTIVE CHAIN.  IN NO EVENT SHALL D.I.D HAVE ANY LIABILITY WHATSOEVER FOR ANY PERSONAL INJURY OR PROPERTY DAMAGE CAUSED BY DEFECTS IN THE CHAIN AND IN NO EVENT SHALL D.I.D BE LIABLE FOR ANY MONETARY DAMAGES, INCLUDING COMPENSATORY, CONSEQUENTIAL, INCIDENTAL, SPECIAL AND/OR PUNITIVE DAMAGES.

D.I.D SPECIFICALLY DISCLAIMS ANY IMPLIED WARRANTIES, WHETHER BY STATUTE OR OTHERWISE, INCLUDING ANY WARRANTY OF MERCHANTABILITY OR WARRANTY OF FITNESS FOR A PARTICULAR PURPOSE OR USE WITH RESPECT TO ANY D.I.D CHAIN.

PURCHASER’S SOLE AND EXCLUSIVE REMEDY UNDER THIS WARRANTY SHALL BE LIMITED TO REPLACEMENT OF ANY DEFECTIVE D.I.D CHAIN.

DID KM501E, KM500 and KM500R Chain Tools Limited Warranty:

Daido Corporation of America warrants that the DID KM501E, KM500 and KM500R chain tools will be free from defects in material and workmanship under normal use and service for a period of one (1) year from the date of purchase shown on the sales invoice or receipt. In order for the warranty to apply and to receive a replacement chain tool, the entire chain tool with all component parts along with detailed description of the warranty problem should be returned to the dealership from which it was purchased.  Chain tools must be returned within thirty (30) days of the date on which a defect occurs.  No warranty shall apply to chain tools that have been subject to misuse, misapplication, accident, or abuse unless proof is submitted to the satisfaction of Daido Corporation of America that such misuse or abuse was not a cause for the claimed defect.  This limited warranty shall apply to DID KM501E, KM500 and KM500R chain tools and shall not apply to cutting pins. Replacement cutting pins are available through your local dealers.

Limitations and Exclusions:

The sole responsibility and liability of Daido Corporation of America and your exclusive remedy under this limited warranty for any and all defects arising out of the manufacture of the product, shall be to repair or replace the defective chain tool at Daido Corporation of America’s option.

IN NO EVENT, WHETHER AS A RESULT OF A BREACH OF CONTRACT, WARRANTY, TORT (INCLUDING NEGLIGENCE), OR OTHERWISE, SHALL DAIDO CORPORATION OF AMERICA OR ITS PARENT OR AFFILIATED ENTITIES BE LIABLE FOR ANY COMPENSATORY, SPECIAL, CONSEQUENTIAL, INCIDENTAL, OR EXEMPLARY DAMAGES OR EXPENSES, INCLUDING BUT NOT LIMITED TO, COSTS OF REPLACEMENT PRODUCT(S), LOSS OF PROFIT, GOODWILL, REVENUES, LOSS OF USE OF PRODUCT OR ANY ASSOCIATED EQUIPMENT, DOWN TIME OR COSTS OR CLAIMS OF THIRD PARTIES FOR ANY DAMAGES OR EXPENSES.

No warranty shall apply to any chain tools containing a defect as a result of any of the following: (i) misuse, abuse, or neglect; (ii) lack of reasonable and proper maintenance; (iii) repairs improperly performed or replacement parts improperly installed; (iv) use of replacement parts or accessories not conforming to Daido Corporation of America specifications which affect performance and/or durability; (v) alterations or modifications not recommended or approved in writing by Daido Corporation of America; (vi) wear and deterioration occasioned by the misuse of the product; (vii) use of non-recommended lubricant; or (viii) damage caused by sand, water, rust, and/or sediment.
